1. About these terms
These Terms of Service ("Terms") govern your access to and use of the wyohost.com website ("Site") and the general services Wyohost LLC ("Wyohost," "we," "us," or "our") makes available through it. By using the Site you agree to be bound by these Terms.
If you purchase a maintenance, hosting, or care plan, the Hosting & Maintenance Terms also apply and govern in case of conflict on those services. If we license you software or code, the End User License Agreement also applies. How we handle data is described in our Privacy Policy.
2. Use of the website
You may use the Site for lawful purposes. You agree not to:
- scrape, crawl, or copy substantial portions of the Site without our written consent;
- attempt to interfere with the Site’s normal operation or security;
- impersonate another person or misrepresent your affiliation with anyone; or
- use the Site to transmit unlawful, harassing, or infringing material.
3. Services we offer
Wyohost provides website design, development, hosting, maintenance, search engine optimization, performance auditing, and AI/automation services. The specific scope of any engagement is described in a separate written proposal, statement of work, or care plan agreement and is governed by that document together with these Terms.
Pricing displayed on the Site is illustrative; final pricing for a specific engagement is set in writing before work begins.
4. Account & communications
If you submit a contact form, schedule a call, or sign up for a recurring service, you authorize us to contact you at the email address and phone number you provide for purposes related to your inquiry or engagement. You can opt out of marketing communications at any time without affecting service-related messages.
5. Intellectual property
All content on the Site — including the Wyohost name, logo, design, photography, copy, code, and structured data — is owned by Wyohost LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws.
For client work, ownership of the deliverables transfers to you upon final payment, except for: (a) third-party components subject to their own license; (b) Wyohost’s pre-existing tools and methodologies; and (c) anything specifically excluded in your statement of work. We retain the right to display non-confidential client work in our portfolio unless you ask us not to.
6. Third-party services
The Site links to and integrates with third-party services such as Cal.com, Google Fonts, and (where applicable) n8n, Stripe, Cloudflare, and others. We are not responsible for the content, terms, or privacy practices of those services.
7. Disclaimer of warranties
The Site is provided "as is" and "as available." To the maximum extent permitted by law, Wyohost disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.
8. Limitation of liability
To the maximum extent permitted by law, Wyohost LLC and its founders, employees, contractors, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Site or the services we provide. Our aggregate liability for any claim arising from these Terms or the Site shall not exceed the amount you paid Wyohost in the twelve (12) months preceding the claim, or one hundred US dollars ($100), whichever is greater.
9. Indemnification
You agree to indemnify and hold harmless Wyohost LLC and its founders, employees, contractors, and agents from any claim, loss, liability, or expense (including reasonable attorneys’ fees) arising from your breach of these Terms, your violation of any law or third-party right, or your misuse of the Site.
10. Termination
We may suspend or terminate your access to the Site at any time, for any reason, with or without notice. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will survive.
11. Governing law
These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Site shall be brought exclusively in the state or federal courts located in Park County, Wyoming, and you consent to personal jurisdiction there.
12. Changes to these terms
We may update these Terms from time to time. The "last updated" date at the top of this page reflects the most recent change. Continued use of the Site after a change means you accept the updated Terms.
